The new National Transition Plan 4.0 has two main objectives:
1) To stimulate private investment;
2) To give stability and certainty to enterprises with measures taking effect from November 2020 to June 2023.
NEW DURATION OF THE MEASURES
The new tax credits are granted for 2 years; the start of the measure is advanced to November 16th 2020.
It is confirmed the possibility, for contracts for the purchase of capital goods defined by 31/12/2022, to benefit from the credit with the payment of a deposit of at least 20% of the amount and delivery of the goods in the following 6 months (then, by June 2023).
ANTICIPATION OF FRUITION TIMES
For investments in “ex super” capital goods and non-4.0 intangible assets made in 2021 by entities with revenues or compensation of less than 5 million euro (Small- and medium-sized companies), the tax credit is available in 1 year.
In addition, immediate compensation (from the current year) of the credit related to investments in capital goods is allowed.
For all tangible capital goods tax credits, the use of credits is reduced to 3 years (instead of 5 years).
THE BENEFITS OF THE NEW TRANSITION PLAN 4.0
The Transition Plan 4.0, confirmed in the new 2021 Budget Law, replaces the previous Company 4.0 and the measures planned up to last year, including hyperamortization and oversupply.
The benefits provided by the new Plan are mainly of a fiscal nature and consist of the tax credit for investments in tangible assets 4.0.
The expected rates of investments in tangible goods 4.0 is 2.5 million at 50% in 2021 and 40% in 2022; from 2.5 million to 10 million at 30% in 2021, and 20% in 2022; from 10 to 20 million at 10% in 2021 and 2022. In many cases of purchasing material goods 4.0 a technical report and/or expert report will be required.
WHO IS TARGETED BY THE NEW TRANSITION PLAN 4.0
Pursuant to art. 185 of the Budget Law 2021, the Transition Plan 4.0 is aimed at all enterprises resident in Italy, including the permanent organizations of non-residents, regardless of their legal form, the economic sector to which they belong, the size and the tax regime for determining the company’s income, which make investments in new capital goods intended for production facilities located in the territory of the Country, from 16 November 2020 until 31 December 2022.
